-make online orders;
-know the status of orders being prepared and delivered;
-consult the details of orders placed and their invoices;
-take advantage of exclusive benefits immediately applicable to open orders;
-obtain personalised quotations;
-create lists of purchases registered online;
-consult statistics drawn up from the analysis of orders placed, according to the periodicity defined by the customer;
-configure preferences for receiving commercial prospecting messages (newsletter, catalogue, etc.).);
-define a customised order validation circuit that can be automatically applied according to the conditions defined by the customer.
This document is specific to this space and does not have the effect or object of restricting or replacing other contractual documents enforceable against customers of Bruneau Italia, such as order forms, General Terms and Conditions of Sale, Customer Data Protection and Contact Information Policy and Cookie Policy.
2. Purpose
The purpose of these Special Terms and Conditions is to set out the terms and conditions and present how a Bruneau account can be created and used on the bruneau.co.uk website.
These Special Terms and Conditions apply to the customer regardless of whether or not he or she has made purchases. Opening an account entitles the customer to use the personal space and associated services within the bruneau.co.uk site.
3. Duration
These Special Terms and Conditions come into effect from their acceptance by the contact person named on the Bruneau account, as representative of the legal entity customer, when the Bruneau account is created and until its final closure.
4. Enforceability
These Special Terms and Conditions are enforceable upon acceptance by the legal entity client, represented by the contact person who created the account, upon creation of the Bruneau account.
Bruneau Italia reserves the right to make any changes it deems necessary and useful to these Special Terms and Conditions. The version of these Special Terms and Conditions that is enforceable against the user of the Bruneau account is the version accessible on our website bruneau.co.uk.
5. Creating a Bruneau account
To open a Bruneau account, you first need to fill out an online form accessible on the bruneau.co.uk website
. The Bruneau account creation procedure is followed by a person designated for this function by the customer, in most cases the account administrator, who will have access and administration rights.
The Bruneau account creation procedure via the online form is carried out in the following steps:
- Step 1: the administrator fills out the registration form, certain fields of which are identified with an asterisk to indicate that they are mandatory. The fields to be filled in refer to the legal entity customer and the administrator himself. The information provided must be accurate and updated regularly;
- Step 2: the administrator takes note of and accepts these Special Terms and Conditions by ticking the box provided for this purpose;
- Step 3: once the form has been completed, the administrator validates it and receives an email confirming the creation of the account at the email address he or she will have indicated when creating the account. The creation of the Bruneau account generates a customer code for the legal entity customer;
- Step 4: the administrator logs into the Bruneau account for the first time and, if necessary, completes the creation process by adding other contacts, registering one or more payment methods or setting up an order validation circuit.
6. Customer contacts
Each Bruneau account is associated with a customer of the Bruneau Italia legal entity. However, each customer can associate one or more contacts to the account, who have separate usage rights on the account:
- the administrator has the right to use all the features available on the account, as described in the introduction. By default, when the account has only one contact, this is the administrator. However, it is possible to have several administrators for the same account;
- the user can only access the order sending functionality, excluding other functionality, which is reserved for the administrator(s).
The list of contacts and their status can be viewed in the 'Contacts associated with the account' section of the Bruneau account.
7. Accessing the Bruneau account
Access to the Bruneau account is via the administrator's address or the client code generated during registration, regardless of which contact is logged in.
If more than one contact is logged into the Bruneau account, the contact concerned will be asked, after entering the login credentials and before logging into the account, to select their profile from the list of registered contacts. This selection assumes that the account will be used in his or her name.
8. Rights and duties of contacts
Even if the Bruneau account identifies a client who is a legal entity, it is assumed that the use of the account is made in the name of the contact connected to the latter and in accordance with his/her rights.
In this sense, the contacts undertake:
- not to use the account for purposes other than those for which it has been created and made available to clients; - not to commit acts of counterfeiting, not to reproduce, download, represent or modify, in part or in whole, the Bruneau account; - not to hinder the proper functioning of the Bruneau account in any way.
In addition, the contacts agree to be responsible for the preservation and confidentiality of the account access credentials and undertake to take all useful measures to ensure their confidentiality.
In the event of loss of the password, the administrator can generate a new password by clicking on "Forgotten password" on the account access screen.
The administrator is also advised to change the password regularly to ensure its full effectiveness and security, noting that the "My password" feature of the Bruneau account allows this to be done.
Account information profile
The "Profile" tab of the Bruneau account allows the account information to be updated in real time, in particular
- the password,
- the facility's contact details,
- the contact details of the administrators,
- the customer address book containing the facility's potential addresses,
- the bank card details saved in order to simplify the online ordering process, on the understanding that storing the bank card is not mandatory,
- the list of contacts associated with the account, with full name, address and rights of each,
- the customer's preferences regarding paper subscriptions and subscription to Bruneau newsletters.
10. Setting up a validation circuit
The Bruneau account allows you to configure an order validation circuit which allows, by default, for all orders or for orders above the value determined by the customer, to request the validation of one or more contacts registered on the account.
To configure a validation circuit, the administrator must access the "Validation circuit" tab and fill in the form, where it is required to indicate the threshold amount for applying the circuit and to identify one or more contacts who will act as validators and who will have to approve the orders.
As with the other fields to be filled in, the validation circuits registered can be updated or deleted at any time according to the customer's needs.
11. Properties
The Bruneau account structure and its content remain the property of the Bruneau Italia company. The data and content provided by the customer through the contact(s) registered in the account and necessary for its administration remain their property.
12. Test agreement
The connection data, logs and other technical data are regarded by the parties as having evidential value. This provision is therefore to be regarded as a test agreement.
13. Personal data and cookies
The Bruneau Italia company acts in compliance with the legislation on the protection of personal data, in particular with the General Data Protection Regulation (GDPR) and the recommendations of the Garante per la protezione dei dati personali.
For further information, Bruneau Italia customer contacts can refer to the Data Protection Policy at the bottom of the page on the bruneau.it website.
14. Invalidity
If one or more of the provisions hereof are held invalid or declared invalid by application of a law, regulation or following a final decision by a court of competent jurisdiction, the other provisions shall retain all their force and effect.
15. Applicable law and place of jurisdiction
These Special Terms and Conditions are governed by Italian law. This applies to the substantive and formal rules, irrespective of the place of performance of the substantive or ancillary obligations.
The Italian courts are competent to hear any disputes relating to these Special Terms and Conditions.
